MUMBAI The Central Bureau of Investigation (CBI) said there was no need for Rhea Chakraborty or Mumbai police to register a separate FIR against the sisters of actor Sushant Singh Rajput and the doctor, when the agency was “meticulously’’ investigating his death.
The FIR filed by Bandra police in Mumbai against Priyanka and Meetu Singh, sisters of Sushant Singh and a doctor is “not valid in law’’ said the CBI. “Registration of second FIR concerning same circumstances is barred in law,’’ since it is probing an abetment of suicide case said the CBI.
The sisters have sought quashing of an FIR registered at Bandra police station on Rhea’s complaint against them and a doctor for procuring alleged fake prescription of psychotropic drugs sans consultation for their brother.
The CBI in its reply to the sisters’ petition agreed that the FIR against them is “based on conjectures and surmises” of Rhea based on the alleged prescription. The CBI requested the HC to pass “orders as deemed fit in interest of justice” after submitting that “if allegations in the FIR prima facie do not constitute an offence, it can be quashed.’’ The FIR against the sisters contain “mostly presumptive and speculative” allegations said CBI.
The allegations made by Rhea in the FIR “could have been well looked into during the ongoing CBI investigation,’’ said the Central agency. It said she could have “directly shared with CBI’’ any information regarding death of Sushant Singh, “however they chose to register a separate FIR.’’
The CBI also said that It had received a request from Rhea through jail authorities (when she was in custody in the NCB case) to drop section 306 (abetment of suicide)under Indian Penal Code (IPC) invoked by the Bandra police based on her complaint against the sisters, since she was advised that a second FIR cannot be registered for section 306 in Sushant’s case. The CBI said her request“cannot be acceded to’’ as an FIR can either be quashed by court or result in chargesheet or closure reports.
The CBI said that Rhea should “not have kept silent till September” if she “was aware of the mobile phone chat between Rajput and his sister Priyanka in June, 2020”. It said its probe is being conducted “without being hindered by any external factors in an impartial manner.”
The CBI said in a case of abetment, “instigation” or “aiding” is required. “If these ingredients are not available, a case of abetment cannot be made out,’’ it said adding it is already investigating the “role of each and every person, whosoever had instigated or abetted the commission of suicide by the deceased.
